ARTICLE 1. INTRODUCTION

K2 Labs FZE (“K2 Labs,” “Company,” “we,” “our,” or “us”) respects the importance of privacy and is committed to transparency regarding the collection, use, disclosure, storage, transfer, retention, and processing of information in connection with the Services.

This Privacy Policy is intended to provide notice regarding K2 Labs’ information practices and shall be interpreted broadly and consistently with applicable law.
1.2 Acceptance
By accessing, downloading, installing, registering for, purchasing, subscribing to, interacting with, or otherwise using any Service, you acknowledge that you have reviewed and understood this Privacy Policy.
Where required by applicable law, your continued use of the Services constitutes consent to the collection, use, disclosure, transfer, retention, and processing of information as described in this Privacy Policy.
1.3 Relationship to Other Agreements
This Privacy Policy forms part of the legal framework governing the Services and should be read together with any applicable Terms of Service, End User License Agreement, Subscription Agreement, Enterprise Agreement, or other contractual terms governing the Services.
In the event of a conflict between this Privacy Policy and a separately executed written agreement between K2 Labs and a customer, the written agreement shall govern to the extent of the conflict.
1.4 Geographic Scope
The Services may be accessed from jurisdictions throughout the world. K2 Labs operates internationally and information may be collected, processed, stored, transferred, and accessed across multiple jurisdictions. Users acknowledge that privacy and data protection laws may differ between jurisdictions and that information may be processed in countries that provide different levels of legal protection than the jurisdiction in which the user resides.
ARTICLE 2. SCOPE AND APPLICABILITY
2.1 Covered Services
This Privacy Policy applies to all Services made available by K2 Labs, including current and future:
- iOS applications;
- Android applications;
- web applications;
- websites;
- desktop software;
- APIs;
- artificial intelligence systems;
- machine learning systems;
- beta products;
- research products;
- enterprise offerings;
- communications and support channels; and
- any related products, features, or services.
2.2 Covered Individuals
This Privacy Policy applies to information relating to: visitors; users; customers; subscribers; trial users; enterprise customers; prospective customers; applicants; business contacts; and other individuals who interact with the Services.
2.3 Third-Party Services
The Services may contain links to, integrate with, interact with, or otherwise rely upon services, applications, websites, technologies, platforms, software, or products operated by third parties. K2 Labs does not own or control such third-party services and is not responsible for their privacy practices, content, security measures, policies, or operations. Users are encouraged to review the privacy policies of third parties before interacting with such services.
2.4 Excluded Information
This Privacy Policy does not apply to information that has been anonymized, de-identified, aggregated, transformed, synthesized, or otherwise processed such that it is no longer reasonably associated with an identifiable individual to the extent permitted by applicable law.
ARTICLE 3. DEFINITIONS
3.1 Account
“Account” means any profile, registration, subscription, authentication credential, user identity, or account established in connection with a Service.
3.2 Affiliate
“Affiliate” means any entity that directly or indirectly controls, is controlled by, or is under common control with K2 Labs.
3.3 Content
“Content” means any information, material, communication, submission, prompt, instruction, query, request, response, output, text, image, video, audio recording, document, file, dataset, metadata, code, feedback, or other material transmitted, uploaded, submitted, created, generated, received, or otherwise made available through the Services.
3.4 Personal Information
“Personal Information” means information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual, household, account, device, or other identifiable entity, as defined under applicable law.
3.5 Service Provider
“Service Provider” means any vendor, contractor, consultant, advisor, processor, subprocessor, infrastructure provider, cloud provider, analytics provider, payment processor, artificial intelligence provider, professional advisor, or other third party engaged by K2 Labs.
3.6 User
“User,” “you,” or “your” means any individual, entity, organization, representative, device, or account that accesses, uses, interacts with, or otherwise engages with the Services.
3.7 Usage Information
“Usage Information” means information regarding the operation, use, performance, engagement, interactions, functionality, behavior, analytics, diagnostics, or activities associated with the Services.
ARTICLE 4. INFORMATION WE COLLECT
4.1 General Collection Authority
Subject to applicable law, K2 Labs may collect, receive, access, obtain, generate, derive, infer, combine, analyze, create, process, retain, and otherwise handle information relating to individuals, devices, accounts, transactions, communications, and interactions with the Services. The categories described in this Privacy Policy are illustrative and not exhaustive.
4.2 Information Provided By Users
K2 Labs may collect information that users voluntarily provide in connection with the Services, including account information, registration information, profile information, contact information, subscription information, transaction information, communications, support requests, survey responses, feedback, preferences, settings, and any other information submitted by users. Users are solely responsible for the information they choose to submit.
4.3 Content Submitted Through The Services
K2 Labs may collect and process Content submitted, uploaded, transmitted, generated, created, received, stored, shared, displayed, or otherwise made available through the Services, including prompts, instructions, queries, responses, messages, comments, documents, files, photographs, images, videos, audio recordings, metadata, datasets, communications, generated outputs, and other materials.
4.4 Information Collected Automatically
When users access or interact with the Services, K2 Labs may automatically collect information regarding devices, systems, networks, browsers, operating environments, usage activity, performance, diagnostics, engagement, technical characteristics, and interactions with the Services.
4.5 Device and Technical Information
K2 Labs may collect information regarding devices and technologies used to access the Services, including identifiers, operating systems, software versions, browser information, language settings, network information, IP addresses, device characteristics, diagnostic information, crash information, performance information, and related technical information.
4.6 Usage Information
K2 Labs may collect information concerning how users interact with the Services, including feature usage, interactions, navigation behavior, session activity, engagement metrics, referral information, timestamps, transaction activity, performance data, and other information relating to use of the Services.
4.7 Location Information
Where permitted by law and enabled through device settings, permissions, or technical functionality, K2 Labs may collect information relating to the location of users or devices. Location information may be derived from GPS signals, IP addresses, wireless networks, Bluetooth technologies, device settings, communications networks, or other location-related technologies.
4.8 Information Received From Third Parties
K2 Labs may receive information from affiliates, business partners, service providers, payment processors, analytics providers, cloud providers, artificial intelligence providers, authentication providers, public sources, commercial sources, and other third parties. K2 Labs may combine such information with information collected directly from users.
4.9 Inferred, Derived, and Generated Information
K2 Labs may create, generate, infer, derive, model, estimate, predict, classify, segment, aggregate, synthesize, or otherwise produce information based upon information collected through the Services, relating to preferences, interests, behavioral patterns, engagement characteristics, usage patterns, risk indicators, and other derived characteristics.
4.10 No Obligation To Verify Accuracy
K2 Labs does not undertake any obligation to verify the accuracy, completeness, or reliability of information provided by users or third parties and may rely upon such information as received.
ARTICLE 5. HOW WE USE INFORMATION
5.1 General Authorization
Subject to applicable law, K2 Labs may use, access, review, analyze, process, reproduce, modify, adapt, combine, organize, store, transfer, disclose, retain, create derivative works from, commercialize, and otherwise utilize information collected through the Services for any lawful business, operational, commercial, research, security, compliance, development, or strategic purpose.
5.2 Operation of the Services
K2 Labs may use information to provide, operate, maintain, support, administer, monitor, troubleshoot, optimize, improve, personalize, and secure the Services, including authenticating users, managing accounts, processing transactions, administering subscriptions, facilitating communications, providing customer support, and maintaining system integrity.
5.3 Product Development and Improvement
K2 Labs may use information to develop, enhance, improve, expand, test, evaluate, validate, optimize, and commercialize the Services and related technologies, including product development, feature development, quality assurance, debugging, testing, benchmarking, analytics, experimentation, and performance optimization. Users acknowledge that K2 Labs may use information to support the development of products that do not yet exist at the time such information is collected.
5.4 Artificial Intelligence and Machine Learning
To the maximum extent permitted by applicable law, K2 Labs may use Content and other information submitted through the Services in connection with the development, operation, maintenance, improvement, testing, evaluation, validation, training, retraining, tuning, optimization, monitoring, safety review, and commercialization of artificial intelligence systems, machine learning systems, large language models, recommendation systems, predictive technologies, automation systems, and related technologies, including for:
- training artificial intelligence systems;
- improving artificial intelligence systems;
- evaluating model performance;
- conducting safety and security testing;
- improving accuracy and reliability;
- reducing harmful or inappropriate outputs;
- developing future models and technologies;
- conducting internal and commercial research; and
- any other lawful business purpose.
5.5 Communications
K2 Labs may use information to communicate with users regarding accounts, subscriptions, transactions, service updates, product changes, technical notices, security notices, support requests, legal notices, surveys, marketing communications, promotional activities, and other business-related communications. Users may have the ability to opt out of certain marketing communications as required by applicable law.
5.6 Analytics and Research
K2 Labs may use information to conduct research, analytics, measurement, modeling, forecasting, reporting, statistical analysis, benchmarking, and experimentation to understand, improve, and commercialize the Services.
5.7 Personalization
K2 Labs may use information to personalize content, recommendations, functionality, communications, user experiences, and other aspects of the Services through automated systems, algorithms, artificial intelligence systems, or other technologies.
5.8 Advertising and Marketing
K2 Labs may use information to market, advertise, promote, distribute, measure, improve, and commercialize the Services and related products. K2 Labs reserves the right to introduce advertising-supported services, sponsored content, promotional features, or advertising technologies in the future.
5.9 Security and Fraud Prevention
K2 Labs may use information to detect, investigate, monitor, prevent, mitigate, respond to, and remediate fraud, abuse, misuse, unauthorized access, security incidents, suspicious activity, policy violations, and other harmful activities.
5.10 Legal Compliance and Enforcement
K2 Labs may use information to comply with applicable law, respond to governmental requests, comply with court orders, establish or defend legal claims, enforce agreements, enforce company policies, and protect the rights, property, and safety of K2 Labs, its affiliates, users, and third parties.
5.11 Corporate Operations
K2 Labs may use information in connection with accounting, auditing, compliance, governance, risk management, financial reporting, strategic planning, fundraising, due diligence, investment activities, corporate transactions, and related operational functions.
5.12 Reservation of Rights
The examples in this Article are illustrative and not exhaustive. Subject to applicable law, K2 Labs reserves the right to use information for any purpose that is compatible with the operation, development, protection, improvement, monetization, commercialization, administration, or lawful conduct of its business.
ARTICLE 6. DISCLOSURE OF INFORMATION
6.1 General Disclosure Authority
Subject to applicable law, K2 Labs may disclose, share, transfer, provide access to, license, assign, transmit, distribute, or otherwise make information available to third parties where K2 Labs determines such disclosure is reasonably necessary, appropriate, desirable, or beneficial for the operation, development, administration, protection, commercialization, monetization, improvement, or lawful conduct of its business.
6.2 Service Providers and Subprocessors
K2 Labs may disclose information to Service Providers engaged to assist in the operation, support, development, maintenance, security, improvement, commercialization, or administration of the Services, including cloud providers, hosting providers, infrastructure providers, analytics providers, artificial intelligence providers, machine learning providers, payment processors, customer support providers, communication providers, monitoring providers, security providers, professional advisors, consultants, auditors, and other vendors. Service Providers may be located in any jurisdiction.
6.3 Affiliates and Related Entities
K2 Labs may disclose information to its current or future Affiliates, subsidiaries, parent entities, sister companies, successor entities, controlled entities, affiliated ventures, and related organizations for purposes consistent with this Privacy Policy.
6.4 Business Partners
K2 Labs may disclose information to business partners, integration partners, strategic partners, distribution partners, technology partners, research partners, commercial partners, enterprise customers, and other third parties with whom K2 Labs maintains a business relationship, in connection with integrations, joint offerings, collaborative projects, product development, commercial arrangements, marketing, distribution, and related initiatives.
6.5 Artificial Intelligence and Technology Providers
K2 Labs may disclose information to artificial intelligence providers, machine learning providers, data processing providers, automation providers, cloud providers, model providers, infrastructure providers, and related technology partners. Users acknowledge that Content submitted through the Services may be processed through third-party systems utilized by K2 Labs.
6.6 Professional Advisors
K2 Labs may disclose information to attorneys, accountants, auditors, consultants, insurers, financial advisors, tax advisors, investment bankers, corporate advisors, compliance professionals, and other professional advisors as reasonably necessary in connection with its business operations.
6.7 Compliance With Law
K2 Labs may disclose information where necessary or appropriate to comply with applicable law, legal obligations, regulatory requirements, governmental requests, court orders, legal process, or law enforcement requests, and to protect legal rights.
6.8 Protection of Rights and Interests
K2 Labs may disclose information where necessary or appropriate to protect the rights of K2 Labs, users, or third parties; prevent fraud; investigate misconduct; enforce agreements; enforce company policies; protect public safety; address security incidents; or prevent unlawful conduct.
6.9 Corporate Transactions
Information collected through the Services constitutes a valuable business asset of K2 Labs. Accordingly, K2 Labs may disclose, transfer, assign, license, sell, convey, contribute, pledge, or otherwise make information available in connection with mergers, acquisitions, dispositions, asset sales, equity sales, financing transactions, fundraising activities, investment transactions, reorganizations, restructurings, insolvency proceedings, change-of-control transactions, due diligence processes, and any actual, proposed, or contemplated corporate transaction, before, during, or after completion of a transaction.
6.10 Aggregated and De-Identified Information
K2 Labs may disclose aggregated, anonymized, de-identified, synthetic, statistical, derived, benchmarked, inferred, or otherwise non-personal information to any person or entity for any lawful purpose, without restriction unless otherwise required by applicable law.
6.11 Reservation of Rights
The categories of disclosures described in this Article are illustrative and not exhaustive. Subject to applicable law, K2 Labs reserves the right to disclose information for any lawful purpose connected to the operation, protection, development, improvement, monetization, commercialization, administration, financing, restructuring, or lawful conduct of its business.
ARTICLE 7. ADVERTISING, ANALYTICS, COOKIES, AND TRACKING TECHNOLOGIES
7.1 General
K2 Labs and its Service Providers may utilize cookies, SDKs, APIs, pixels, tags, web beacons, local storage technologies, device identifiers, attribution technologies, analytics technologies, advertising technologies, session technologies, machine learning systems, and other technologies designed to collect, process, measure, analyze, monitor, store, or transmit information relating to the Services. These technologies may be deployed directly by K2 Labs or by third parties acting on behalf of K2 Labs and may change over time without notice except where required by applicable law.
7.2 Analytics Technologies
K2 Labs may use analytics technologies to understand how users interact with the Services, identify usage patterns, evaluate performance, diagnose issues, improve functionality, develop new products, measure engagement, and support business operations.
7.3 Attribution Technologies
K2 Labs may utilize attribution technologies to understand how users discover, access, install, engage with, subscribe to, purchase, or otherwise interact with the Services, including information relating to advertising campaigns, referral sources, installation events, conversions, user engagement, and transaction activity.
7.4 Cookies and Similar Technologies
The Services may use cookies and similar technologies to operate and maintain functionality, remember preferences, authenticate users, secure accounts, improve performance, measure engagement, analyze usage patterns, support personalization, facilitate communications, improve products and services, and support other lawful business purposes. Users may be able to manage certain cookie settings through browser controls or device settings; however, disabling cookies may affect the functionality, performance, or availability of certain features.
7.5 Device Identifiers
K2 Labs may collect, use, process, and associate information with device identifiers, account identifiers, advertising identifiers, installation identifiers, browser identifiers, application identifiers, network identifiers, and similar identifiers for security, analytics, attribution, fraud prevention, account administration, product development, advertising, personalization, and other lawful business purposes.
7.6 Advertising Technologies
K2 Labs reserves the right to utilize advertising technologies, advertising platforms, audience measurement technologies, targeting technologies, retargeting technologies, conversion measurement technologies, campaign management technologies, and related systems. Although certain Services may not presently display advertisements, K2 Labs reserves the right to introduce advertising-supported products, sponsored content, promotional placements, and advertising partnerships in the future.
7.7 Reservation of Rights
K2 Labs reserves the right to implement, modify, replace, discontinue, expand, or otherwise utilize technologies, tools, systems, providers, methodologies, and techniques designed to support the operation, development, security, improvement, monetization, commercialization, administration, measurement, marketing, advertising, or lawful conduct of the Services and K2 Labs’ business.
ARTICLE 8. ARTIFICIAL INTELLIGENCE, MACHINE LEARNING, USER CONTENT, AND MODEL IMPROVEMENT
8.1 General
Certain Services may incorporate artificial intelligence systems, machine learning systems, large language models, generative AI systems, recommendation systems, predictive technologies, automated decision-making systems, classification systems, computer vision systems, speech processing systems, and other automated technologies (collectively, “AI Systems”).
8.2 Rights To Process Content
To the maximum extent permitted by applicable law, K2 Labs may collect, access, review, analyze, process, reproduce, store, modify, adapt, transform, combine, organize, classify, extract, derive insights from, create derivative works from, and otherwise utilize Content submitted through the Services, including prompts, instructions, queries, requests, responses, outputs, uploads, communications, documents, files, media, metadata, usage information, feedback, and related materials.
8.3 AI Development and Improvement
K2 Labs may use Content and related information for purposes including developing, training, retraining, improving, evaluating, validating, benchmarking, monitoring, optimizing, testing, auditing, and commercializing AI Systems, as well as improving model performance, reliability, safety, accuracy, security, and efficiency; developing future models, technologies, products, and services; and any other lawful business purpose. Users acknowledge that Content submitted through the Services may contribute to the ongoing improvement and development of K2 Labs technologies.
8.4 Feedback and Improvement Suggestions
Any feedback, suggestions, recommendations, ideas, comments, proposals, evaluations, bug reports, enhancement requests, or other submissions provided to K2 Labs may be used by K2 Labs without restriction, compensation, attribution, notice, approval, or obligation. K2 Labs shall be free to incorporate such feedback into existing or future products, services, technologies, and commercial offerings.
8.5 No Confidentiality Expectation
Unless expressly agreed in a separate written agreement executed by an authorized representative of K2 Labs, users should not assume that Content submitted through the Services will be treated as confidential. Users should avoid submitting information that they are unwilling to have processed in accordance with this Privacy Policy.
8.6 User Responsibility
Users are solely responsible for Content submitted through the Services, the legality and accuracy of submitted Content, obtaining necessary rights and permissions relating to submitted Content, and ensuring that submitted Content complies with applicable law and contractual obligations.
8.7 AI Outputs
Outputs generated by AI Systems may be incomplete, inaccurate, misleading, biased, outdated, offensive, inappropriate, unpredictable, or otherwise unsuitable for a particular purpose. AI-generated outputs may contain factual errors, omissions, hallucinations, inaccuracies, inconsistencies, or other defects. Users are solely responsible for reviewing, evaluating, validating, verifying, and independently assessing any output generated through the Services.
8.8 No Professional Advice
Unless expressly stated otherwise in a separate written agreement, AI-generated outputs do not constitute legal advice, financial advice, accounting advice, tax advice, medical advice, engineering advice, professional advice, or any other regulated professional service. Users shall not rely upon AI-generated outputs as a substitute for independent professional judgment.
8.9 Future Technologies
The technologies utilized by K2 Labs may evolve over time. Users acknowledge that K2 Labs may develop, acquire, license, deploy, integrate, or otherwise utilize technologies that do not currently exist at the time information is collected. To the extent permitted by applicable law, information collected through the Services may be used in connection with such future technologies.
ARTICLE 9. INTERNATIONAL DATA TRANSFERS AND GLOBAL PROCESSING
9.1 International Nature of the Services
K2 Labs operates internationally and the Services may be accessed, utilized, supported, maintained, developed, monitored, administered, or otherwise operated from multiple jurisdictions throughout the world. Users acknowledge that information collected through the Services may be transferred across national, regional, territorial, and international borders.
9.2 Cross-Border Processing
Information may be collected in one jurisdiction and processed, stored, analyzed, transferred, accessed, disclosed, reviewed, monitored, backed up, archived, or otherwise handled in another jurisdiction through K2 Labs, its Affiliates, Service Providers, business partners, contractors, advisors, infrastructure providers, cloud providers, artificial intelligence providers, and other authorized parties.
9.3 Different Legal Frameworks
Users acknowledge that jurisdictions may maintain different privacy, security, consumer protection, disclosure, governmental access, surveillance, discovery, and legal process requirements. Information transferred to a jurisdiction may become subject to the laws of that jurisdiction, which may differ from those applicable in the jurisdiction in which the information was originally collected.
9.4 User Consent to International Transfers
By accessing or using the Services, users acknowledge and, where required by applicable law, consent to the transfer, storage, processing, disclosure, access, review, analysis, and handling of information across international borders, including transfers to jurisdictions that provide a different level of protection than the user’s country of residence.
9.5 Lawful Transfer Mechanisms
Where required by applicable law, K2 Labs may implement contractual, organizational, technical, operational, or legal measures intended to facilitate lawful international transfers of information. The implementation of such measures shall not be construed as limiting K2 Labs’ ability to engage in lawful international processing activities.
ARTICLE 10. DATA RETENTION
10.1 General Retention Principles
K2 Labs retains information for periods determined by K2 Labs in its discretion, subject to applicable law and legitimate business requirements. Retention decisions may take into account operational requirements, legal obligations, compliance considerations, business needs, security requirements, research activities, product development activities, evidentiary needs, dispute resolution requirements, and other legitimate interests.
10.2 No Fixed Retention Period
Except where required by applicable law or a written agreement executed by K2 Labs, K2 Labs does not commit to any specific retention period. Different categories of information may be retained for different periods of time. Certain information may be retained indefinitely where permitted by applicable law.
10.3 Backup Systems and Archives
Information may remain within backup systems, archival systems, disaster recovery environments, redundancy systems, logs, historical datasets, analytics systems, machine learning systems, security systems, and related technologies after deletion from active systems. K2 Labs is not obligated to immediately remove information from such systems except where required by applicable law.
10.4 De-Identification and Transformation
K2 Labs may retain information that has been aggregated, anonymized, de-identified, pseudonymized, transformed, synthesized, modeled, derived, or otherwise processed into a form that is no longer considered Personal Information under applicable law. Such information may be retained indefinitely.
10.5 Account Closure
Closure of an account, cancellation of a subscription, termination of a relationship, or cessation of use of the Services does not automatically require the deletion of information. K2 Labs may retain information following account closure or termination as permitted by applicable law and consistent with this Privacy Policy.
ARTICLE 11. DE-IDENTIFIED, AGGREGATED, DERIVED, STATISTICAL, SYNTHETIC, AND MODEL DATA
11.1 General
K2 Labs may create, generate, derive, infer, transform, aggregate, anonymize, pseudonymize, de-identify, model, synthesize, classify, segment, benchmark, analyze, and otherwise process information collected through the Services into forms that do not constitute Personal Information under applicable law.
11.2 Ownership and Rights
To the maximum extent permitted by applicable law, all de-identified, aggregated, anonymized, statistical, synthetic, derived, benchmarked, modeled, inferred, or otherwise transformed information created by or on behalf of K2 Labs shall be owned exclusively by K2 Labs. Nothing in this Privacy Policy shall be interpreted as granting users any ownership interest in such information, datasets, models, analyses, benchmarks, insights, technologies, improvements, or related materials.
11.3 Commercial Use
K2 Labs may use, reproduce, modify, distribute, publish, license, sell, commercialize, transfer, disclose, display, share, monetize, and otherwise exploit information described in this Article for any lawful business purpose, including research, product development, marketing, analytics, benchmarking, reporting, commercialization, licensing, investment activities, and strategic partnerships.
11.4 Deletion Requests
Where a user exercises a deletion right under applicable law, K2 Labs may retain information that has been anonymized, de-identified, aggregated, transformed, synthesized, derived, modeled, or otherwise processed such that it no longer constitutes Personal Information under applicable law. Nothing in this Privacy Policy shall require K2 Labs to delete information that is not legally required to be deleted.
ARTICLE 12. SECURITY
12.1 General
K2 Labs implements administrative, organizational, technical, physical, contractual, and operational measures intended to protect information against unauthorized access, acquisition, disclosure, alteration, destruction, misuse, loss, or other unauthorized processing. Security measures may evolve over time in response to technological developments, operational requirements, security risks, legal requirements, and business considerations.
12.2 No Absolute Security
No system, technology, infrastructure, network, software platform, database, transmission method, storage environment, security program, or operational process can guarantee absolute security. Accordingly, K2 Labs does not represent, warrant, or guarantee that information will be completely secure, immune from attack, free from unauthorized access, or protected against all risks.
12.3 User Responsibilities

To the maximum extent permitted by applicable law, K2 Labs shall not be responsible for unauthorized access, disclosure, loss, destruction, corruption, theft, interception, misuse, or alteration of information caused by third parties, cyberattacks, malicious actors, force majeure events, failures of third-party infrastructure, user actions, user omissions, internet failures, telecommunications failures, or circumstances beyond K2 Labs’ reasonable control.
